These Terms of Service ("Terms") govern access to the EndlessCut website and the EndlessCut Windows desktop application (the "Software").

By creating an account or using the Software, you agree to these Terms. If you do not agree, do not create an account or use the Software.
1. Who we are
1.1. EndlessCut is the trading and product name of Viktoriya Lisitsa, an Australian sole trader.
1.2. Legal, privacy, and refund notices may be sent to Viktoriya.Lisitsa@outlook.com.
1.3. The website is https://endlesscut.net.
2. The Software
2.1. EndlessCut is desktop software for turning short clips and still images into long-form loop videos.
2.2. The current version is provided for Windows 10/11 64-bit.
2.3. A macOS version is not currently provided.
2.4. You are responsible for confirming that your computer meets the published system requirements before purchase.
3. Licence
3.1. Subject to these Terms and payment of the applicable fee, you receive a limited, non-exclusive, non-transferable licence to install and use the Software for its intended purpose.
3.2. Ownership of the Software and all related intellectual property remains with Viktoriya Lisitsa. These Terms do not transfer copyright or other exclusive rights.
3.3. Each paid licence is for use on one device at a time.
3.4. Each paid access period is 30 days, unless a different period is clearly stated at the time of purchase.
3.5. You must not share your account, activation code, or licence with others, or attempt to circumvent device limits, licence checks, or security controls.
4. Price and billing
4.1. The current published price for 30-day access is US$59.90.
4.2. The amount charged is the price displayed at checkout immediately before you authorise payment.
4.3. Access is sold as a fixed 30-day period. There is no automatic recurring billing unless a later checkout flow explicitly discloses a recurring charge and you authorise it.
4.4. Stripe may be used to process card payments when that payment method is enabled. These Terms do not describe Stripe as already available.
4.5. EndlessCut does not store full card data. Card details, if collected, are entered with the payment provider.
5. Accounts
5.1. You must provide an accurate email address and keep your password confidential.
5.2. Creating an account does not, by itself, grant a paid licence.
5.3. We may suspend or close an account that is used to abuse the service, breach these Terms, or compromise security.
6. Payments and refunds
6.1. Paid access, cancellation, and refunds are described in the Payment, Cancellation and Refund Policy.
6.2. Personal information is handled under the Privacy Policy.
7. Consumer rights
7.1. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
7.2. Nothing in these Terms excludes mandatory consumer rights that cannot be waived under the law of your country of residence.
8. Liability
8.1. The Software is provided for its published purpose. We do not promise that every source file, computer, or output setting will produce a particular commercial result.
8.2. To the extent permitted by law, and without limiting section 7, we are not liable for indirect or consequential loss, lost profits, or lost data arising from your use of the Software.
8.3. Where liability cannot be excluded, our liability is limited to resupply of access or a refund of the amount paid for the affected period, as required by applicable law.
9. Changes
9.1. We may update these Terms for future purchases. The version accepted at checkout applies to that order.
9.2. Material changes will be reflected in a new version date on this page.
10. Governing law
10.1. These Terms are governed by the laws of Australia and the applicable Australian state or territory.
10.2. That choice of law does not limit mandatory consumer protections that apply in your country of residence.
